July 17, 2013— --CVS has announced it will no longer pay $8.1 million to settle lawsuits claiming the drug makers improperly sold a generic version of Viagra to doctors.
The settlement comes after CVS reported that it could have paid the full $1.3 million it received in 2015 from two generic manufacturers to settle lawsuits.
The drugmaker also agreed to cover the $1.4 million it paid to resolve a lawsuit brought by former CVS employees who say the company’s patent on Viagra had been infringed.
Viagra, a pill meant to treat erectile dysfunction, is manufactured by Pfizer Inc. and is sold under the brand name Revatio.
In 2015, Pfizer paid $8.1 million to settle two lawsuits claiming the drug maker had improperly sold the drug. The company agreed to pay $1.3 million to resolve the claims, the suits say.
The lawsuits claimed that Pfizer and other generic manufacturers improperly marketed the drug to doctors by offering the drug for their patients to treat erectile dysfunction. CVS Health said it will pay $1.3 million to resolve the litigation.
The lawsuit was filed in federal court in the Eastern District of Pennsylvania.
In 2012, a jury awarded $1.9 million in damages to three plaintiffs, who allege Pfizer and other drug makers had conspired to sell a version of Viagra called sildenafil citrate to treat erectile dysfunction.
The case is part of a class action lawsuit filed by plaintiffs who say they were injured by the sales of a generic version of Viagra to doctors.
In 2011, a jury in Philadelphia granted $1.3 million to resolve a suit brought by CVS alleging the drug maker had engaged in a scheme to fix prices at its retail pharmacies.
The lawsuit said the drugmaker failed to adequately warn doctors about the increased costs of the prescription drug.
“Patients should be very cautious when choosing the treatment they are choosing to take. This is a sensitive area, and it’s critical to patients to have knowledge of the risks associated with their choices,” said David L. Schiller, a lawyer with the National Association of Boards of Pharmacy.
The plaintiffs claim Pfizer, which is the world’s largest manufacturer of prescription drugs, had an incentive to increase its drug sales by marketing a generic version of Viagra, which was not approved by the FDA. The lawsuit, which also called for a settlement of other similar class-action lawsuits, says Pfizer has repeatedly denied any knowledge of the increased costs of the prescription drug.

The lawsuit said the drugmaker failed to warn doctors about the increased costs of the prescription drug. In 2011, a jury in Philadelphia found Pfizer liable for $5.2 million in damages to three plaintiffs, who allege they were injured by the sales of the drug.
The plaintiff said the drugmaker failed to properly warn doctors about the increased costs of the prescription drug.
In 2014, a jury in Philadelphia found Pfizer liable for $5.2 million in damages to three plaintiffs, who allege they were injured by the sales of the drug.
In 2015, a jury in Philadelphia found Pfizer liable for $1.3 million in damages to five plaintiffs, who allege they were injured by the sales of the drug.
In the case of a class action lawsuit filed by women who say the drug maker had conspired to fix prices at pharmacies, the women say they were paid hundreds of dollars in fines and other damages.
“These women are taking the pharmaceutical industry to a farce and putting their health at risk,” said L. J. Weintraub, a law professor at Yale University.
